Employer/lawyer should send a written request (a letter) to withdraw the request for review/appeal. DOL should then reply back with a confirmation letter stating that the request for review has been cancelled. Only then, the LC case is considered as "officially denied".
The request for appeal needs to be withdrawn before re-filing. In other words, a new PERM labor certification application cannot be filed (according to DOL) while an appeal is pending for the same alien, same job and same employer.
Reqeust for review or request for appeal must generally be avoided unless the alien needs a pending labor certification application (for more than 365 days) for the purpose of obtaining a 7th year H-1B extension beyond the normal 6-year limit.
If the alien has plenty of time left on his H-1B...
$5500 seems very expensive for LC process. Reputed attoneys like Sheela Murthy or Rajiv Khanna charge around $4000 to $4200 for Labor Certification alone.
PERM takes a minimum of 61 days to prepare and file from the day you get PWD (prevailing wage determination). If your lawyer is very busy...

I am glad things went well for you. Just hope everybody here gets approved soon. I had the feeling that Chicago was much better than Atlanta in terms of approvals and speed of adjudication. Hope I am wrong. :)
1) It looks like the DOL (BEC) is giving you a chance to retain your PD. By just re-advertising Or by amending your 750A , you will be able to keep the same PD.
2) EB2 or EB3 gets decided by what is mentioned on Item 15 of ETA Form 750A. If this item says that the min. job requirment is...

Looks like your Labor may have to be re-advertised. This time, your lawyer needs to make sure that ads exactly match the min. job requirements (education + expereince + skills) as stated in the ETA 750A form.
