No 45 day letter yet
Hi guys,
I have not received my 45 day letter yet (PD 12/2001 MD, moved to DOL 2/2004).
Should I be concerned? Is there anyway to check status? I emailed about a month back and got a new case number but that's it.

I called the number provider by icici. the lady said she is not allowed to provide info on individual cases. She said they have begun keying in 2001 cases now. Earlier they were keying cases randomly from 2002, 2003 etc. Now they see a need to key cases from 2001. She said there are...
My PD is Dec 01 from MD and it moved to Philly in Feb 04. No 45 day letter yet. The only news I heard was when I emailed status@DAL.DFLC.US - after 1 month they sent me my new case number. This is what I wrote:

Thanks. Is there anybody who has not received a letter from MD with a PD of December 01 or close to it? Also is there a way to check status via phone? I sent an email and got my new case number a few months back but that was it.

My PD is Dec 2001 from Maryland. My LC moved to DOL in Feb 2004. I have not received my 45 day letter. Should I be concerned? Are there others in the same boat?
Got new case number via email reply
I sent a mail to the status@dal...email address. I got a reply today a month after I sent it with my new case number and no additional info. I have not received my 45 day letter yet. PD is 12/2001 from MD transferred to Philly in Feb of 04.
Is the PD going to change based on when you respond or am I reading this wrong??? I thought PD will be the date your LC app was received by SESA. Did something change in the PD rule?
PD Retrogression and extending H1
Gurus,
If the PD for 485 application retrogresses earlier than an applicant's PD, can you still extend your H1 beyond 6 years if it has been more than 1 year since you applied for your LC?
I was afraid that this would happen when it moves to the contractors (BEC). If Philly DOL is picky what fate awaits us at the BEC? :mad:
I hope the lawyer's do a good job of appealing those cases.

If that were true, then this whole BEC letter process is an exercise in futility for the DOL. While their process is inefficient and very very slow, the premise would have been on sound analysis - the economic downturn saw a lot of folks lose jobs plus the frustrating pace of DOL certification...
The reason BEC is sending letters is to confirm if the applicant still needs to be adjudicated. I wonder what percent will reply asking for adjudication. If the percent is low it should speed up processing.

Update from lawyer
I checked thru' HR with my lawyer. My lawyer checked with other lawyers in maryland. Only a small percentage of their clients have received letters. She expects letters to come in the next two months (her guess).
