Can Kenneth White ask DOS/KCC for a full disclosure of previous years?

Do you have factual data on that? If I'm not mistaken, DOS released the numbers of winners according to regions/countries, but didn't slice the numbers by day of application.

Can Kenneth White ask DOS/KCC for a full disclosure of previous years?

The judge can order DOS to release the info DOS must have all the information from previous years, and it's very relevant for the case of the 22k. It's actually good if DOS will try to hide the info - then it'll be clear that such "computer errors" happened in the past.

Can Kenneth White ask DOS/KCC for a full disclosure of previous years?

There were many rumors about the lottery in previous years - that in DV 2011 many (most?) of the winners were from the last 2 days, or that in 1995 they were from 2-3 days in the middle, etc. Now if that was the case, then the 22,000 still have a chance. Even if the results of DV 2011 would...

Lottery by regions only or also by countries?

This is exactly my point - the lottery is NEVER random. There are limitations even within the regions, and not surprisingly, most countries do have selectees, something that would haven't happened if the process were purely random. I'm one of the 22,000 and I'm really tired of people here on...

Lottery by regions only or also by countries?

Hi, I know the lottery is drawn according to regions, and there's a formula for a number of selectees from each region (Africa, Europe, Asia, etc.). Here's my question: is there a limit per country as well? According to the State Dept., in DV 2012 about 9 million applicants out of 14.7...

Does the 60-day rule apply to people selected in DV 2012 (AOS)

Hi all, I have a question which is very relevant for people who intend to do Adjustment of status while on F-1/F-2 or J-1/J-2 visas and go abroad over this summer: The USCIS uses a rule that if you enter the US on a non-immigrant visa (including F and J), and try to do AOS within 30 days...

DV 2012 winner who was previous J1 and not passed 2 years home residence.......Urgent help

First of all make sure you're really subject to the 2-year home residency requirement. The DS-2019 should determine that (the visa stamp could be misleading). If you ARE subject, see who was your sponsor: if it was the U.S. govt. (via Fulbright or other programs) then the chances to get a...

DV-2012- How urgent is it to file right now?

Thanks for your answer. The only question is when exactly should we send the DSP-122: I know the USCIS has a "60-day" rule, meaning that if you enter the country on a non-immigrant visa (like my J-1) and try to do AOS almost right away (in the first 2 months) they'll consider you as someone...

DV-2012- How urgent is it to file right now?

Hi all, My spouse was selected for further processing. We both live in the U.S. (I'm a postdoc on J-1 and she's on J-2). In the past I was a Fulbrightee, so I returned home and stayed there for about 2 years. The thing is I might have to complete another 15-17 days (USCIS might count the...

    Second J-1

24 months bar vs. 12 months bar If you were out of the country for full two years you're fine. Keep in mind there are other restrictions even if you're not subject to a 2YHRR: 1. 12 months bar applies to the exchange visitor who was in the U.S. in the preceding 12 months as a J-1...

    j1 home requirement

Counting the days You should reside a total of at least 2 years (=730 days) in your home country, but it can be aggregated. A visit to the US (on a B-1/B-2 visa) won't restart your count, but every day that you spent outside your country would be probably added to your 730 days. Let's say you...

RFE 485 ON J-1 FOREIGN RESIDENCE REQUIREMENT//am i subject to it?? Deadline, pls advise

Funding Personally I think you're NOT subjected, especially because the clause in your IAP-66 states clearly you didn't receive any funding from the US government/your country's government or any other int'l organization. It'll be very hard to pin a 2yhrr on you. On the other hand, I'm...

Do I have 2yr residency requirement?

I'm sorry to say that I don't have any experience with waivers: as an ex-Fulbrightee I'm currently serving the 2yhrr in my country. Please note that No Objection letter from your home country might not be enough if you had a US govt. funding. Look at other threads in this forum, as some...

Do I have 2yr residency requirement?

I think that your 2yhrr does indeed apply. It's not due to the skill list, but simply because you had J-1 with US government funding: in and of itself such funding usually triggers the 2yhrr.

Is asking for an Advisory Opinion shows an immigration intention?

Hi all, I'm an ex-Fulbrightee who is currently serving the 2YHRR (completed about 9 months so far). I'm considering taking a one-year job offer from a US university on a J-1 visa. It has no govt. funding and it's not on a skills list, so I'm almost sure it doesn't carry a 2YHRR. Yet I'd like...

How strict is the 2-year home requirement day count?

Thanks Raevsky Thank you for your quick reply. OK, I have to bug you with a follow-up question: do you know of any cases where people who had, say, 710 or 720 days of physical presence were denied an H visa (or green card) because they didn't reach the full mark? I'm asking this since I...

How strict is the 2-year home requirement day count?

Hi all, I'm a Fulbrightee (got my Ph.D. in the US and worked for a year afterward) and I just returned home to begin my 2-year home residency requirement. I'd like to consult other people who have been in a similar situation: how strict is the calculation of the days? Is it really 730...
