Will you please clarify me doubt. I am on EAD from EB3 category.And I got my EB2 I140 got approved in 2008, but the priority date of that one is EB2 but not EB3. Then I got RFE in 2009 on my I485, and replied back. My question is, is USCIS ported my case to EB2 with the EB3 priority date ? and RFE got means already my case is moved to EB2.

I got my I140 approved for EB3 which is applied in 2004, right now I am on EAD.And also I got labor & I140 got approved for EB2 also, which is applied in 2007.But the priority date for EB2 I140, I got is 2007.My attorney sent letter to USCIS for porting the priority date of EB3 which is 2004. I need to know that how many days it will take for that one to be ported. And also if I am going to call USCIS or meet local USCIS officer, what I need to ask, simply if I give my I485 case they will tell whether my case is EB2 or EB3 and its priority date. Because I140 is employer property, we don't have that one. Please let me know Khannaji.
