We have applied for I-140 in April, 2007 and I-485/EAD/AP in August 2007 and received EAD and AP in November 2007 and Jan 2008 respectively.
In April , 2008, I-140 was denied and subsequently we have filed I-290B(MTR) and my EAD is expiring in October, 2008. We have not used EAD so far, continuing on H1B.
Currentlly I290B(MTR) is pending.
We would like to know, whether we can apply for EAD/AP now or do we need to wait until I-290B/I-140 approval. What are the chances to get EAD when I-140/I-290 are pending.
