I was going through the forum .It has got lot of questions answered on various visas to US . I have the following querries.
My wife has completed her 5 years in USA on L1B visa and went back to india on August 3,2008.I am in USA on H1b valid till februay 2011.
1) Can her employer file L1A(valid for 7 years) now or they can apply only after one year stay out of US.
2) If her employer can not file L1A in near future ,I want to have H4 for her and she can visit US in mrach 2009 and stay here till may end 2009 .Does this effect the one year stay out of US . In such case will this 3 months deducted from 365 days or she has to be out of US for one year from may 2009 ?
