About 15 years ago, trying to enter USA, (after 1st time that I was in the USA for a little over 6 months) I got caught by an immigration officer who started questioning me, took my passport and finally let me go stating that I will get a notice for hearing by mail which I got by never appeared for that hearing. I stayed in the USA 15 years ago after that and just left the USA about 3 months ago.
My husband is USA citizen and we got married about 8 years ago when we were in the USA but never tried to apply for a green card because of my situation.
Both, me and my husband are out of state for the past 3 months, I want to file for I-130, Petition for Alien Relative but were not sure if I will need a waiver of inadmissibility as well, since I did not see my status fits any category in form I-601 as I consider my status: Failure to Attend Removal Proceedings.
Am I right? What are my options? also, If i do need the waiver, do i mail it with the I-130 or wait? Please help.
