  • My case details:
    I got my H1B stamped through a consultant in 2008 and the petition (I-797B) is valid till Sep 2011.
    Though my H1B was stamped in 2008, I never traveled on H1B.


    My L1 was filed by my current company in Mar 2010, and I entered US on L1 status in Apr 2010, which is also my current status.
    When I got my L1 stamped in Delhi's US Embassy, my earlier H1B stamping was "Cancelled without Prejudice".


    My I-94 is valid till Apr-2013.


    Requirement and Queries:
    I want to work on a H1B.


    Query1. Can I have a L1 to H1-change of status (COS)? If yes, how?
    Query2. Will my prior H1B petition be valid and can be transfered by another consultant on his name who is filling for my COS OR filling a new petition will be better option?
    Query3. What is the turnaround time for each case in Query 1 & 2 ?
    Query4. Can I stay in US with a legal status based on my I-94 being on leave without my payroll being generated by my current company? And if so, for how long ?
