You are in the wrong discussion. My situation is different than yours. My situation is when I applied for my H-1 extension last time INS approved it beyond 6 years( I did not get the extension by using S.2045). I have applied for my GC in Dec 1997 and labor is cleared.

I got my H-1 approved beyond 6 years(1 year 8 months more). I applied For my GC in Dec 1997. Am I eligible under section 245(i)? (Consider that I am wroking beyond 6 years).

What do you mean, Not everybody expiring his H-1B (6 years). Only the people whose PD is more than 365 days old and must have applied for I-140.

You guys or missing something here. Shusterman site says clearly that the people are not eligible to get 1 year extensions if their petition is with labor department. Read the following.....

What is your priority date. If your priority date is 1 year ago you are eligible to get 1 year extensions. Even if you go to canada, Your current employer wants continue your GC process, there won\'t be any effect on your I-140.

Go to the shusterman.com and click on AILA analasys. They Clearly mentioned that 1 year extensions only apply to the people who have been filed their I-140. I hope your wife will file the I-140 before April 01.
