Is it possible to have my sponsor submit an application of urgency stating that they need me to come back and fill in the position at a government agency I was supposed to work at under an H-1B, when the government agency who isn't allowed to sponsor gives a written statement?
I was working for a government agency on a J-1. At the end of my program, the government agency applied for a waiver for the 2 year home requirement for me. At the same time, a sponsor company applied for an H-1B (but I will still be working for the government agency).
Meanwhile the cap was...
I know it's bad timing... it looks like I am going to leave the country during the 30 days grace period in July and hopefully come back some time in September with my new visa. I hope that this will work out timewise!
I can't extend my J-1... as trainee you can only stay for 18 months and thi time will be up.
I heard though that it might go quicker to obtain a waiver from a IGA then with the no objection letter, so I am just hoping it will work out... or maybe I won't even need the waiver!
I talked to two people at the DOS... one told me it takes 4 weeks, the other said 2 months... in either case I'll be better off to apply for the waiver as well now!
:D
But for the advisory opinion... they don't look on the I-94, do they? I didn't have to make a copy of it. Just fill in some information about the I-94 number.
I am trying to get out the Adivsory Opinion and the Waiver application at the same time. If I wait for the Advisory Opinion and then start the waiver application, it will take months!
I don't have that time... my sponsor wants me to start on a different visa in October.
Of course, all this...
My I-94 doesn't have a note at all... neither "subject" nor "not subject"... what does that mean in this case?
I did file for an advisory opinion though.
