From my understanding being out of status isn't too bad as long as you (or in this case the kids) entered legally. My lawyer told me she had cases were the spouse was out of status for 10 years and there weren't any problems with the AOS. As long as you can proof the legal entry to the US.

Get married asap.... :-)
If you want to stay in the US and get a Green Card, you should marry your boyfriend BEFORE your J1 runs out. The easiest would be to marry in the US and apply for adjustment of status (AOS) straight away. It is a very straight forward process, and depending on where you...
First of all: What does it say in your DS-2019; are you actually subject to 2-years home rule or are the boxes unchecked? Second: If you are subject, do you know why and if you really can obtain the waiver?
If you can apply for no objection waiver, you might be able to get it in time. I send my...
Waiver approved! That was a lot quicker than I thought it would be:
3/01/10 DS-3035 package arrived at DoS (Fedex)
3/02/10 Check cashed
3/04/10 German embassy sent No objection letter
3/19/10 Case online
Form DS-3035 Received March 19, 2010
Form DS-2019 Received March 19, 2010
Passport Data...
No worries, tatibb. You only send the package to the DoS and they will forward their recommendation to USCIS. You will receive a copy of the recommendation from the DoS and the the final notice from USCIS.
After your case got entered to the system it takes longer for the NOS to show up. My case showed up 3/19, the NOS from the embassy was entered 3/26. I have heard from people where it took several weeks until the NOS NOS showed up in the system.
Your case just got recently updated, right? I'd...
I used the case number from the advisory opinion in my waiver application and it worked fine. However, my case showed up online 3 weeks after I sent it. I've read somewhere that it does depend on from where you are, I am not sure if that's true.
I wouldn't think so because you already have a waiver - why would you want to apply for another one?
I have never heard about I-612 but I just looked it up. It gives you only two options as reasons for waiver application: exceptional hardship or discrimination in your home country. So it really...
Update: No objection statement received 3/26.
Ford, yes, I would think that you can send in your application to the DOS without the embassy letter. In fact, I read somewhere that it is recommended to wait with the embassy letter until your case is in the system. Not sure if that really helps...
You will definitely need the waiver for the interview. I am in the same situation, I applied for AOS even though I am subject to 2-YHRR. But I already filed for the waiver and if everything goes alright, I will have it before the interview.
In your case I would probably ask an attorney for...
I am pretty sure you will need the waiver. I am not familiar with the J2 status, but I would think that you (J1) have to apply for the waiver with her as a dependent. I mean, you both will need the waiver anyway, because you want to get your green card together with hers, right?
I am applying...
My case is online now. "Received March 19". But the No objection letter from the embassy hasn't ben entered yet although it got send two days after I sent the DS3035. But that's very common from what I heard.
