Your safe bet is to be on H1. The reason being: if for some wildest reason your I485 is denied, you can still continue to work, since you would be on H1.
Please don't get confused with H1 Visa and AP.
You can work on your H1 and still use your AP to travel and come back and continue to work on H1 with the same employer.
AP is just a travel document that allows you to travel abroad and return to US while your I485 is pending. Thats all is there...
Lets keep the discussion at a more professional level. Don't keep on saying that "there is no reason for VO to deny your H1". Please come out of that mind set. You have a problem and you have to start looking at all aspects.

Why do you think your H1 would be denied? Is the company that you moved (company B) not doing good? Did you not move to a company that is better then the previous company?
I say, just respond to the RFE and be cool. Do you think if you go back to company A, they would welcome you back...
If my understanding is correct: Your company has applied for an H1 Extension...is that right?
Generally, until you get the final ruling you are not adding any unlawful presence, here in US. If the outcome is not favorable to you, then you got to pack the bag A.S.A.P. heading homeland.

Well! wait till Aug and I hope your sponsoring company files your H1 again after Aug 15th 2008. You get h1 for 1 year...based on your Labor certification.
If your company has filed your I-140, and if its approved, then you can apply for 3 year extension and you don't have to wait till Aug 15...
h1b_7thyear, Can you give the exact dates...or close to approximation, when you H1 expires/expired? Did you ever travel abroad while you were on H1? What is the exact physical (no. of days/years) stay in US? When was the labor filed? when was I-140 filed?
