I came to US in Aug07 and my prior experience is 2yrs.I have been with the same employer till now and I am in my (5th Yr). My visa is going to expire in Sep2012.Currently, I have 6yrs of experience.And I hold a Bachelor's degree and Certifications from Microsoft & Oracle. I am a IT Developer.
1. Can I apply in EB2 or EB3 with the same employer
2. If I transfer my H1 to a new employer and then will I be eligible for Eb2 or Eb3?
3. What is the potential risks involved now to transfer H1 & apply Eb2 or Eb3.
4. Can the LC & I140 for EB2 or EB3 can be done in Premium processing?
5. I am working for a client and there is a Primary vendor layer between my client and my employer. Will this situation effect any of the process?
6. If I Transfer my visa to the primary vendor of the client company. What are the risks involved. And what would be my eligibility for Eb2 or EB3.
All my concern is about my extension of visa after an approval of I140.
Please suggest me in this regard.
