My 140 filed in July 07 and I am in 8th year and got H1 extension until Jan 2010.
Got an ability to pay RFE on I 140. USCIS asked for my 06 and 07 w2 's and employer financial statements.
My w2's for 06&08 are over the LC wage(76K).
and 07 w2 got only 35 k (short of 41K). My employer reported 40K, 25K profits in 06 & 07 and have positive funds flow. But he reported 20K losses in my priority year 05 and I have 10K less on my w2 than the LC wage for 05.
Considering the above facts; I have the following questions:
1.) what are the best documents to present to the USCIS
2.) If my I140 denied; do you suggest me to go for a MTR or an Appeal or both to buy more time for my new PERM labor.
4.) If another employer is ready to sponsor me a Labor under future employment; at what point I can transfer my H1 to the new employer.
5.) Can I file a fresh I 140 using the same Labor if my current I 140 denied.
