I am a Canadian Citizen , enter the US in Feb 09 as a visitor , but stayed passed 6 months , I got married to a US citizen in DEC 09 and we are filling for I-130 and I-485 concurrently and I will like to know what will be my current immigration status for filling purposes ...
Ok so if I were to stay more than 6 months in the US ... then I will be out of status .since we can only stay up to 6 months as tourist .... Then how will inmigration know if I was out of status once I leave the US and try to come back ? I just dont want to have any problems next time entering...
I come to the US twice a year to visit friends and clients ..... but always enter by air .. now with the new law since I left by land coming back the same way ... and have no stamp on my passport to proof how long I stayed the first time... I do not want to have any problems

What if my employer files it for me ... Can they do that ? I do not want to go to the border .... Yes it will be my first TN but it is my employer who will take care of application , fees and paperwork.

Thanks for your feedback , I do have letters of my previous employers to back up my experience but do I have to send originals together with my employers I - 129 application for me ?
