If someone charged with DV-Stalking charges and case is pending which is under pre-trial, is it possible to transfer H-1 visa? What are the consequences. Other immigration attorneys told that it is difficult to transfer H1 in this situation and probably he/she won;t get a new H1 visa and that person has to leave the country. Please advice on this.
Also if that person has H-1 visa live with the previous employer, can he/she go back to previous employer's H-1 visa. Please suggest.
