One catch on the Cronin Memo of May 2000 is that "until the final rule is published". And as this Memo was issued 7 years ago do you know if there is a new rule that is published. Is it safe to enter on AP and Maintain H1 B for a trip happening in Dec 2007?

what does FP has to do with name check cleared?
Is it true for the first FP appointment too that they will only send the FP notice when the name check is cleared ?
Suppose somebody just filed in June 07 and gets the FP notice does that mean their name check is clear?

When you say "But in the notice TSC has given Oct2 as receipt date." are you looking at the physical receipt sent out by USCIS or you are just looking at the USCIS website by taking the numbers from back of your check. Because the website normally shows the notice date and you should not worry...
If your dependent has valid H1 he can work any time. If not then dependent must have EAD card to work. It has nothing to do with I-140 approval as long as EAD is approved for dependent he can work.
