Thanks for your wonderful posts. One thing which is not clear is when to conclude that the name check is pending.
Response I received was "Your application is pending review and additional system checks. You
will be
notified by mail once a decision has been made"... does this mean...
I am in the same boat. My Pure concurrent I140,485 was filed on July 9, 2004. I got a response that pending "additional checks"... I guess that is name check but cannot say for sure.
Also the fact that they recommend not to repeat the inquiry for 180 days gives us some indication of what internally they are thinking how long will it take !
Going through Rajiv/ AILA and clarifying (if they are interpreting AC21 wrong) may be our best bet.
I do not think App officers would be that ignorant not knowing about the process. After all, that is what they do day in an out. If there are enough frustrated people waiting for I140 to clear due to name check, may be we should do something about it collectively. I can understand 485 needs to...
I too got a response for my I140 email inquiry from Congressional & Customer Relations Division XII - with the message exactly as yours.
According to my knowledge the name checks are notoriously unpredictable and can take 2 weeks to 2 years.. So I am kind of worried. Is there anyway we can...

I140, 485 RD 7/9/04 (Pure Concurrent)
I140 RFE submitted on 1/18/05, LUDs on 1/26/05 and 2/01/05.
No response or LUD changes till now...
I am in the same boat.
RFE on 140 on Jan 14 responded on Jan 18th. Two LUDs Jan 18th and Feb 1st. No Updates since then.
No Updates on 485 LUD since Dec as well.
I140/485 Pure Concurrent. ND 07/09/2004.
FP Done: 08/05/2004.
Looks like they did some DB refresh or a mass upload (From the email threads). Mine LUD for 485 (not for 140) also changed on 10/27 without changing the status.
They cleared stated in their goals that "Name Check and FP delays" were excluded from the 90 days period. So for example if name check takes 2 months, well you may receive the approval in 5 months. There are posts on other threads that name checks can take as much as even 1 year.

Does anyone know that if they are picking "Random" cases or "All" who applied in one package are eligible for the Pilot? What happens to people who do not get picked -- do they go to the end of the other long queue?! [ Hope not !]
Does anyone know how to figure out if your namecheck is pending? 90 days pilot time is not supposed to include namecheck delays.
