Canadian citizen was denied entry to US via Hawaii airport. The officer said I've overstayed in 2005, 2007 and 2009 (27, 63 and 368 days). I didn't know since no I-94 involve I'm only allow for 6 months. I've been traveling back and fro never been told overstayed the first time until recently.
He made me do record of sworn statement under section 235(b)(1) with question and answer. He advised me to voluntary apply for "withdrawal of application for admission" and pay my own way back to Canada I did, my admission was forgiven. Otherwise I'm banned for 5 years or more and detain in jail overnight.
He said for next 10 years I would require a valid wavier to enter US. What is wavier? Easy to obtain? With NAFTA trade agreement and caselaw Canadian cannot be banned, is it true? Can my application for waiver be denied? Hiring a US immigration lawyer is costly, only solution? I'm also involved in gay marriage (my partner US citizen) and legally married in Massachusetts state.
