I came to US for the first time in Aug-95 on H1B. My LC & I-140 approved in Dec-96 and Feb-97 through employer (A). I went back to India after about 3 yrs and 8 mths and my H1B expired on 31-12-99. In Sept 08, I am back to US on H1B with another employer (B) valid till Sept 2010.
I have the following questions:
1. Can I file GC paper from I-485 stage i.e. taking advantage of my previous approved LC & I-140 while on H1B with employer (B)? If no, will it be possible if I join my previous employer (A) i.e. by transferring my H1B.
2. My current employer (B) is not interested in starting my GC processing; in that case can I start my GC processing as fresh of my own?
3. Currently, I am holding a H1B; can I go for EAD as my I-140 is approved in 1997 while with employer (B)?
