My wife got J-1 waiver in 2006 and now she is on 3rd of her H-1B. I have an approved I-140 with a pending I-485 (EB2) ( PD is Feb 2005 ). My question is with the PD being current for Indian born EB2s can I file I-485/ EAD under "Follow-to-join" for my wife or do I have to wait for her Waiver...
