- Our I-485 petitions were filed in EB-2 category in Aug'07 through my employer with me as direct beneficiary (child and spouse as dependent), for which priority dates (Jan'07) are not current as of date. My I-140 was already approved prior to I-485 filing.
- My spouse filed only I-140 by herself in EB-1(A) category in Jul'09 and it was approved by USCIS in Aug'09, for which priority dates are current. She had not filed I-485 along with I-140.
- USCIS has sent us I-485 approval notices of pending I-485 (filed in Jul'07) and also Green cards for all of us as well in last week. I-485 approval now mentions my spouse as direct beneficiary of immigrant petition in stead of me.
Q: Is it an standard practice of USCIS to approve I-485 petitions filed by one spouse against approved I-140 petition of another spouse for which priority dates are current?
Or is it an error from USCIS?
