Getting back on H1 status from EAD

Wrong answer. If your H1 petition is valid - then you should be able it to get an H1 visa. An approved H1 petition never expires, until its expiry date, unless revoked.

    Any input is appriciated

Precisely my point, people. All I am saying is: Just because you are a Doctor, you cannot simply 'switch' to a PT or Nurse without getting the degree (or diploma) + the license for that profession. Which is quite a lot of work and by no means an easy feat. Many Foreign doctors DO...

    Any input is appriciated

The answer is very simple : can a Physiotherapist or Nurse apply to work as Doctor, anywhere in the world (not just US) ? The answer is NO ! Not unless they get a degree of a Doctor (MBBS, MD, whatever). So how do you expect that a Doctor can practice as a PT or Nurse ?

    FYI - I-485 denial

The best route then is to start with a clean-slate, if possible. Which is, to re-enter US with a new I-94 and filing a fresh I-485. That way, all your past sins are expunged and you can readily leverage on the 245(k) - which consider LAST and ONLY LAST entry. I have discussed with several...

    Emergency Help!! AP and H1!!!

Mine took 10 mins in the Secondary area at SFO in June - but I was the only one in the whole room @ 5 PM. So, it depends on Port of Entry, how many flights land at that time and how many have AP's et al. Besides, glitches can cause delays... In all, its not all that bad - considering the...

What would be my status ???

Folks - this 'informal letter' is a letter which Miller, Deputy Asst. Comm'r, Adjudications, CO 245-C wrote in Jan. 8, 1990. The 245 (K) came into effect MUCH (1997) later. I suggest all those who want to understand 245 (k) read "Never Say "i" " article which can be found on...

    245 (K) and Out of status - F2 - D/S

I was out-of-status for nearly 200 days on F2, due to a lawyer oversight, due to non-filing of my H4. I know there's specific protection available for D/S cases for out-of-status issues, whereby one does not accrue any unlawful presence until specific finding by the USCIS . As soon as I...

Came on F2, H4 applied late, now RFE on I485

Here's some info... Although your wife was out of status, she really wasn't as her I-94 is stamped D/s. There is a very specific law which states that D/S person CANNOT be out-of-status UNLESS a determination is made by USCIS or a immogration judge. This is strange protection that's built in...
