You can stay in US, but can not work
Till you get your H1B status approved, your status does not change from F1 to H1B. So, your current status is F1.
Since you do not have your EAD Extension is approved, you can not work beyond 9/30/08. But, you can stay in US as long as your case is...
Do not change company till H1B is approved.
Security Check can be as long as 6 months to one year. Also in some cases USCIS is giving this as just a reason to delay the case.
Also since your I-94 is changed, you can not join the company B on the receipt notice. Check with attorney if you...
You can only start working for a company when they receive the Actual Receipt Notice from the USCIS. FedEX Tracking Info is not enough.
Ask the company to provide a copy of the Receipt Notice to start working.

Srinivas,
Since your application was once pickedup in the lottery and it is approved, you will not come under Lottery any more. Any company can file an H1B for you and you can travel to US with their approval paper. You do not need one more stamping.

Ramesh,
Questions.
1) If my H1-transfer gets a query, denied. Can I withdraw the H1-Transfer
For Query, employer PQR can either respond or just keep quite. If PQR does not respond by the date given by USCIS, H1B application will automatically be denied.
If Denied, you or...
Wife's Last Name need not be Husband's
Great Guru,
There is no benefit of having the same last names. Me and my wife have separate Last names and we are here for last 8 years. I never had any problem with SSN or Tax Filings.
I have already answered
Prasanth,
I have already answered in the other thread of yours.
Nagiamar,
You can't really take it that way. They are slow in process. One of my friend's company applied in regular processing and check got cleared today. But EAC number on the back of the...
Bluemoon is wrong
Bluemoon,
You are wrong. USCIS will not give RFE because of H1 being applied. They will not mix two applications.
Usually on H4 you can get RFE asking to prove that H1 holder is maintaining proper status. Either Paystubs or a letter from employer will do. Or they...
No you can not
Once you have the H1B Stamped from the Company B, when you are entering into US you will be given I-94 with Company B. So you can not work for Company A. If you want to do that, then you will have to file for H1B transfer from Company B to Company A.
Answers to both
Tina,
USCIS fee is $200 for H4 Application. You can do this by yourself. But, I would suggest you to pay $400 to attorney to do it, so that you will not do any mistakes and regret later. $400 is not a big amount when it comes to getting into problems with USCIS and status...
He is out of status
GotPR is right. It does not matter how long H1B Petition is Valid or how long Visa on the Passport is valid. I-94 is the master. You can only stay in US till the I-94 exp date. Before its expiry either you must file for Extension or leave the country.
I would suggest...
You must have H1 Receipt to file H4
Either you should file H4 with H1B application (this is preferred). Otherwise, you can only file H4 extension with receipt of your H1B Application. Copy of I-129 will not help.
