  • Hi Anand,

I filed for my labor in 2002 (EB2 India) and this GC hunt is turning out to be a truly traumatic experience. I got into the same situation as you last week when my I-140 which was approved in end of 2006 was transferred to AAO and sent back to Nebraska. Now it has the status -

Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I140 IMMIGRANT PETITION FOR ALIEN WORKER on September 8, 2008, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.

This is really troubling me since I have switched employers and lawyers too. I'm not sure if the mail "with next steps" is a RFE". If there is a RFE on my case, I don't know if I would be notified as the status suggests or if it would be my previous lawyers or current lawyers who get the mail from USCIS.

I had a few questions for you though -
    1. When you received this update from USCIS, were you requested to file a NOID and a AC21, or had you submitted the AC21 and NOID before getting the I-140 update about it being reassessed?
    2. Did they approve the I-140 again after receiving the NOID and AC21?
    3. Did the I-140 reapproval trigger a I-485 approval? I read in another forum that a person who had this happen to him, got his I-485 approval within a few days much like you getting your I-140.

I would sincerely appreciate your response Anand.

    Thank you.

    Regards,
    Naren
