I was on H1-B visa and worked for an IT company. I got laid off and decided to apply for H4 visa through my husband's employer/lawyer. The process got delayed between the H1-B expiring(September 2010) and filing the new petition(February,2011). The sluggish Lawyer delayed in filing, when the petition filed I did not have any pay stubs for that month.USCIS sent the queries to present the recent pay stubs questing my valid status between the time elapsed.
My lawyer sent the letter explaining the situation that I was on valid status and and did not work during the time elapsed. They denied my petition. However they have given me the option to motion to reopen. It is now so complicated and I am very exhausted with the matter, please show some possible ways.
