If you are detained for a crime, yes, and if you are on the list of the 39 countries whose cases the president canceled or paused, then also yes.

I don’t think you are 100% accurate here. If you are detained for a crime, yes ICE can hold you. But if you are from one of the country on the ban or partial ban list, it’s got nothing to do with ICE detaining you. And it won’t stop USCIS from issuing your green card when the time comes, reason is because you are getting it from the immigration judge order and not the Uscis. I’m not an immigration attorney, but i have a very good one who keeps me updated.

Quick update, verbal approval was 8/22 in LA. I call the court today. Lady was so helpful, she informed me they haven’t released any 2025 visa for 42b. That they should her something by the end of this month and start processing them mid February
