Successful interview but no decision - Chicago DO

I had my interview today morning. My interview was scheduled for 8:05 AM. I was there by 7:20 AM. Dropped the IL at the front desk at 7:45 AM. I was given a pager. Waited until 8:40 AM when my pager went off. Then an officer came and took me inside. She was very nice and made good conversation. She made me take the oath before sitting. Finished the civic test quickly, then reading and writing. Then she went through my application very quickly. Then she made me sign on the application on the last page. Then I requested her to accept new photos. She did. I mentioned about the recent traffic violation and she asked if there is any arrest involved. I said no and she asked not to bother about it then. This whole process took not more than 7 minutes. Then she said I passed the interview but cannot make a decision because she hasn't received my "A# FILE". The one that kept me waiting for months after finger prints is still in "transit". Unbelievable. She expressed regret and told me that she understands my frustation. She asked if I have any questions. I asked how long do I need to wait and what happens after this. She said as per the rules, she is supposed to make the request twice before declaring the A# file lost and proceeding with the T file she got. She told me that the thin green color file on the desk is the T file (temporary file). She also told me that she realized only yesterday night that my A# file is missing and she put in a request for it already. Also, there will be a gap of 2 to 3 weeks between two requests. She did not make any copies of passport or DL or GC. She just glanced by passport for verifying the full name. She gave me a letter stating that I passed the test but no decision can be taken yet. She said she will review my A# file (standard procedure) as soon as she received it and mail her decision. It's really frustating. She said sorry few times looking at the disappointment on my face. I guess I have to look for the oath tracker thread now.

I have a request. Can someone please post the link for the Chicago DO oath tracker in reply? I couldn't find it. Thanks.

If you don't mind my asking, what's your country (or region) of origin? Regardless, you seem to be almost done. Hang on in there!

This is exactly what happened to me. They misplaced my file and passed my interview based on the copy of N400 I gave to them. Its been 70 days since my interview, I am still waiting for an oath letter. This week I wrote a letter to IO to help locate the file. If I don't hear from them till 120 days, I might need to file 1447(b).

Did you attempt to check back with the local office in the past 70 days? If you did, what was their response? I don't understand one thing. Based on what the IO told me during interview, she got to wait for 15 days before sending the second and final request for A# file again. If nothing happens after that, they will proceed with the T# file they created. So, why are they waiting so long in your case? I am defintely not going to wait that long hoping for some response. I already waited for 4 full months after finger prints to get the interview letter. NBC put in a request for my A# file on Oct 4th, then Nov 23rd and after I wrote a letter to the local senator, within a week they scheduled by interview. Now the local IO says she put in a request for my A# file yesterday. I don't know how her request is any different from the previous requests. I didn't get much confidence after hearing this A# file episode. I am already drafting a letter once again to my local senator. I might wait for a week before mailing it.

Could you please post your detailed timeline? Thanks.

I called 1-800 number, they said they can see in the system that I passed the interview and told me that you have to wait 90 days before they do anything else. I visited local office after 40 days, but they still didn't have my file. Now I wrote a letter to my IO, let's see if this makes any difference. I am going to set-up infopass appointment as well. Maybe I will again call 1-800 number and see what they have to say. After 90 days, I will write letter to congressman or senator. If nothing happens, we always have legal option after 120 days.

You also posted in the Houston OCI tracker indicating that you have US passport already. Here you are waiting for oath letter. I am confused. Did I miss something?

Jalma probably has a little business charging people to file their immigration paperwork. I think the two cases are for different people. Jalma figures it is bad manners to use another attorney's website for personal gain so has posted both cases using the perpendicular personal pronoun (I).

Say it ain't so Jalma...

Jalma, get info pass appointment, I can't believe you haven't done that yet....do it tomorrow.

Good-Luck!

Don't make wild guesses guys.

One case belongs to me.. where I got my citizenship and now waiting for my OCI. The other case belongs to my wife where they misplaced her file and now we are waiting for her oath letter. So I hope this clears everything....

Looking at your posts, I was hoping there is a way to become US citizen while they are looking for the A# file. :) :)
Now you disappointed me. :( :(

Senator Dick Durbin, the local senator is the Senate Majority Whip, 2nd in command in the senate leadership and also senior member of the Senate sub-committee on Immigration and Dept. Of Homeland Security. I thought his profile made some difference last time when USCIS scheduled my interview as soon as the Senator's office send a query to USCIS. I am hoping it will work once again in quickly retrieving my A# file, gone missing since NBC put in a request for it on Oct 2nd 2009.

Hi Spiderman - I am so sorry to hear that these morons can't find your file. I think my case will be similar to yours. Please keep us posted on everything you're going through. Hopefully, your file will be located soon and you'll get your OL in the next few days.
As far as my case goes, I am still waiting for my IL...

Sure, I will keep updating here.

Jalma,
What's the status with your spouse's missing A# file situation? Any luck there? Did you take any further action after you last posting here?

Spidey, this post just to scare you. Look at my sig. However, best wishes to you ... you will hopefully be on track in a few weeks.

You mean the extra 3 years due to lost file during I-485 processing? I heard that they have new regulations in place for lost file cases now. After NBC searches for the A# file and transfers the case to local DO, the DO is supposed to do a search again, then wait for a while (as per the IO, it is 2 weeks), then do a second/final search again, then wait for another 2 weeks before proceeding with the T# file they got. Also, check this link below. I hope they will process it in a month or two.

Yes, things have changed now. This was years back, and some of this was soon after 9/11 when they were unusually slow.

I contacted 1-800 number again, the 2nd level officer told me that my wife's file reached our local office on Jan 11th, 2010. Which is about 60 days after the successful completion of her interview. It's good to know that at least they got the file. I am hoping that they will take come time to review it to make sure everything is correct before they send in the oath letter.

I am not sure if the IO helped in any way to get that file, after I wrote a letter to him regarding oath letter and missing file. I will let you guys know if anything comes up.
