A Big Announcement Likely In Next 24 Hours That Will Resolve Issues

avsrjk
are you EB3, India?

Dear Friends,
Here is the GREAT NEWS. I have got an approval notice for my case , few minutes back. My PD is August 2003. I think they are clearing ALL adjudicated cases. Who knows, if everything goes fine, they might start taking the new 485 applications.

Am so excited. Thanks to this forum.
Regards
Krishna

this proves that USCIS has approved people out of turn inconsistant with their june bulletin

am i wrong?

Forget this . Look at TSC forum. The GEEK reported approval of his/her case.

EB-2 India . PD September 2005. Got in two days before doors closed and now approved as being current on 1st July 2005.

Here am I rotting since 2002 EB2-India and still hoping that by end of next year I may have GC. So much for fair deal and queues.

Aligns with the rumor that TSC has been asked not to reject 485 packages yet

Gravitation: Ok I'll bite.

Was there a 'June Bulletin' issued by the USCIS? Could you be referring to their 'Employer Information bulletin'?
In which case, please provide a link to it and accept my apologies.
Otherwise, how is the June Bulletin (I presume the June 2007 visa bulletin which is issued by the DOS) relevant in July (setting aside for the moment the alleged inconsistency)?

List of folks not approved as per June Visa Bulletin....(Ind-EB3 01JUN03,EB2-01APR04) but confirms the theory that the July Visa Bulletin was effective for 1 sec and hence, justifies their lucky approval...

Sorry, but this is getting really tiresome.

The only role I see for 'Luck' in the whole process is this: Some people (apparently randomly) do not cross the event-horizon of FBI name checks, and consequently get pre-adjudicated quicker than the others.

I believe, based on good evidence, that if you were reported as being documentarily-qualified by the USCIS to the DOS in time for the issue of the July Visa bulletin, a visa number was given to you (A JULY VISA NUMBER) and USCIS will approve your case.

look at ravinka's details.... since shedule A is out of visa, she/he must be in EB3-india........... with PD of 2006, its a clear violation of rules by uscis..

no wonder they exhausted 60k visas....

sachatur....you are EB2-india-2005 ...if i remember right your PD was not current as per june bulletin, right? how can uscis approve your case?

Techy2468:
I was approved with a JULY VISA NUMBER in July when my PD is current.

Read my analysis here:

I'm still waiting for clarification on your (and Gravitation's) position that June Visa Bulletin is relevant now. Here's a link to my request:
http://www.immigrationportal.com/showpost.php?p=1726403&postcount=30
I'll wait for your reply (Gravitation's too).

As per AILA - Consular Posts are going ahead with approvals based on July Visa Bulletin
As per Shusterman.com - he received bunch of approval on July 2nd - as per July Visa Bulletin
Murthy.com also reported approvals in July based on the July visa bulletin.....

As experts have pointed....July Visa bulletin was active for 1 second and that's how USCIS consumed some of chunk of all the 60K numbers .....

What is the Big Announcement ?

Congrats to all the guys getting approved!!
I want to know what about the people like us who cud not get a chance to file 485.Any hope for thet category. My lawyer filed I-140 PP on 28/07 at NSC.
No news yet:(

Oh, and about Ravinka: If I remember right, once they have their I485 in, Schedule A cases can double-dip (special quota and regular eb3) for visa numbers. So no mystery there.
I don't mean to say whatever the USCIS is doing now is not irregular, but I would hope there is a rational basis for what they are doing.

sachatur - I would say - what's the reason for your posts...

Folks here are angry that they are not getting GC's while others are getting it.....and are venting out their frustration through this forum posts...

I would say - just stay quiet and pray to god that they let everybody file I485 in July....Because, if not, you will have to wait for the outcome of the lawsuit between AILF and USCIS to see if your 485 approval stands or gets revoked......though the chances are very slim...but one NEVER KNOWS...Nobody expected July Visa Bulletin reversal, as well REMEMBER!

If AILF wins the lawsuit - the Judge will make USCIS dance to his tune....he can do anything...(e.g USCIS denies I-140 for so many folks and they go to court and fight it out and get USCIS to approve I140...Courts in US are the ultimate law....)

I would say just sit back and enjoy the show...hopefully it will benefit you as well
