Working for self with pending I-485

Lets assume that I-140 is approved and I-485 has been pending for more than 6 months (required to use AC-21).

Now, instead of giving (donating) $ 20/ hr to the GC sponsoring employer, is it legal/feasible to open a company in my name, incorporate it and then work for the new company keeping the same job title. Of course, one would also inform BCIS about the job change.

Has anyone done this and/or is this feasible/legal.

BCIS will require you to be employed by someone other than yourself.

How about incorporating a company under wife's name and working through the same?

I'd be very, very leery of this, because BCIS may want information about your new AC21 employer - since they need to be able to have the financial ability to pay and employ you. If they ask for tax returns or financial statements and the owner of the company comes out, they will probably reject your case.

Bottom line, I wouldn't do this unless I had no other alternative.
