I had filed an application (Form I-102) to request the change in my wife's I-94 for the last name. She's on H-4 and has a valid visa with my current employer till Nov 2006. We had to send in the original I-94 and till now we haven't received the modified I-94(Application receipt notice was dated August 2004).
Now, my wife has to travel to India as my mother-in-law is sick and might need a kidney transplant. Can she travel now even though she doesn't have the original I-94? I have the copy of the I-94, receipt notice for Form I-102 and also a response from USCIS for my enquiry about the delay in processing my request. I want to travel with her too but I am changing jobs now and my new employer will be filing for a transfer of employer next week. Should I wait for the approval notice for the transfer or will the receipt notice be good enough for me to travel with her?
I am kind of lost here so if anyone can help on this or provide some advice, I will really appreciate it.
