What type of visa?

I was watching the Food Network the other night, and they had a 10 minute spot on a pastry chef somewhere in Alabama. He is a French Citizen who, according to the story, decided to move to the United States from France and open up a pastry shop. My first thought was: what kind of visa would he be on? He works for himslef, so it not employment based. His wife is also a French Citizen, so it is probably not family based (unless he had a brother or something). It may have been investor-based, but the story said that all of his employees were imported from France (God knows what visa *they* are on) and I doubt he would passed the $1M threshold.

What gives here? Am I missing something?

AFAIK, chefs usually can get an H1, as specialty occupation. And of course it is possible to have your own company sponsor you for an H1.

I guess he'll be putting a copy of that episode in his self petition for an Alien of Extraordinary Ability.
