Visitor visa after I-130 petition approval

american dream

New Member
Hi,

My uncle petitioned for immigration of my father about 10 years ago. Being from India, his priority date has not yet become current. In the meantime, I came to US on H-1B and recently got Green Card through employment. Now, I want my father to visit me for few months. Does the fact that an immigration petition has been filed on his behalf, makes him ineligible to apply for Visitor visa?

Thanks for your answers.

I have a same situation

Hi,
My Uncle also applied for my parents in jan 1990. They also want to come to US on visitor visa. I talked with my lawyer and she told me that since my parents applied for immigrant visa they can\'t get non-immigrant visa ie., visitors visa.
What do you think? Do you hear same thing from other people? PD for category 4 is moving soo slowly that,i think, it will take another 1.5 years for my parents to get their PD current.
Thanks
Rajat
