Visa number allocation and cut-off dates

Dear Alren, Raju, KD and other CP Gurus -

The November State Dept bullettin mentions that the EB3 category are likely to retrogress in Jan 2005.

If you browse http://www.shusterman.com , the ticker there reads as follows :

"The EB3 category is likely to retrogress (ie becme non-current) back to 2002 for EB3 category for persons born in India, China and Phillipines. "

My question is :-

1. My Priority date is Sept 2001. And I am expecting my interview in Feb 2005. Does that mean that if the EB3 category retrogresses to 2002, I will not be affected ?

Also my attorney mentioned that a visa number is issued when the consulate asks the Department of State to issue a visa number. I guess, it means when the Consulate sends P4. Correct ?

Any inputs would be most appreciated.

The bulletin below hasn't said anything about EB3 or Jan 2005 in particular.

Things are so bad that the H-1b cap was reached on the first day of the fiscal year and the employment -Based preferences for india ,china and the philippines are scheduled to backlog for the first time in years on january 1 2005.

sorry for the subject line
but thats what i could think of. You have the balls rolling on your end,Given the context that PD are going to be announced in Jan 2005, i would wish and hope that by the Jan 10th interview schedule, your , mine and others here interview dates should be scheduled.
Once the interviews get scheduled i dont think the consulates will go ahead and cancel to hold off until PDs are current.
So at this point, make sure that we can do all the things like sending P3 with right info. all documents preped far before so that we can minimize cycles and hope and pray that our numbers will be called in Nov 10,Dec 10 or jan 10 updates.

no such hope for me. I haven't even received p3 yet. no way my interview can be before feb/mar. i'm screwed. especially screwed cause i shouldn't even be in EB3.

You are right - the Nov bulletin says nothing about the regress - it is in the Oct 2004 bulletin. Below is what the bulletin says:

EMPLOYMENT: The increasing CIS use of numbers is likely to require the establishment of cut-off dates in one or more categories during FY-2005. Such action is expected in the Employment Third preference category as early as January.

Rest is all speculation - as to when date the cut-off date are going to established and what the cut-off date would be.
