In reading "Chapter 45 - Waiver of Section 212(e) Foreign Residence Requirement." of the Adjudicator's Field Manual posted on USCIS.gov, it seems that the function of the USCIS in this type of case is purely administerial. In other words, all USCIS can do is process the I-612 is receives from DoS but does not actually have authority to overturn a favorable DoS decision unless they find a factual mistake, fraud, ot other type of inconsistency that warrants additional review.
Thoughts?
