Urgent help for extension of H1

I just fogot to renew my H! visa, and it is already expired at 06/30/2005.
I am doing it now,
1. whether I am legal to stay at USA.
2. whether I need back to my home country to get the H1
3 whether when my case is pending , I am legal to stay here
4. usually how long it take
5 , whether there is 10 days buffer to stay at USA after the H1 expired

I know one of the answers:
5- You do have 10 days buffer to stay at USA after H1 expires... You have filled up 7 of those days.
