travel borderline case

My H1B expires on 5 May 2002.I have filed for extension this week
I want to make q quick trip to India for a week and return by April 30.
will there be a problem for reentry since only 5 days remaining on existing visa.Also my current stamping shows expiry of NOV 2001 but I have a I94 for May 5.
Also will there be a problem to get stamping for 5 may with my current I 94
 since there are not many dyas remaining.

Check with your lawyer...it becomes tricky when you

leave the country with H1 pending...get in to all sorts of I-94

there would be a problem as its dependent on your visa and not i 94 as you surrender i 94 as soon as you leave the country if the visa does not have a valid date then they will stop you at your airport when you are coming back
