My labor was filed on jan 29th 2004. My H1 was expiring on june 17th 2004, I filed for an extension based on recapture of time spent in India and have successfully recd an extension for 6 months till dec-2004. My service center (Wisconsin) is still processing labor applications with priority date as dec-23rd 2003 , so I am not sure whether my labor will be approved before dec/2004 (thats when my H1 expires) also I won't be eligible for 7th yr extension as my labor was filed only in jan. Can anyone suggest me a way out from this situation so that I can stay here and continue with my GC processing.
2. If I have used up all the 6 yrs of my H1 can I change my status to H4(based on my spouse's H1) ? Is the 6 yrs period common for H4 and H1 or separate ???
Any help/suggestions wud be highly appriciated.
