Your question is poorly worded, since neither H1 or TN holders have a "choice" to file 1040NR or 1040, if they have spent sufficient days in US. By IRS rules they must file 1040NR if they have not met SPT, and must file "dual-status" (1040NR/1040) if they do meet SPT.
However, citizens of certain countries (including canada) , regardless of work status, can use the tax treaty to file a 1040NR regardless of the number of days they spend in US -- if they meet the treaty definition of residency in another country -- or can file full year 1040 if their treaty has a non-discrimination clause (like canada's)
