Substitute 140

My company has an Approved 140 for a person and he left the company. Now i have following questions:

1. Can i use that approved 140?
2. I have a Bachelors degree in Engg and if he is a MCA (master in Computer applications) then can i still use it. I have around 7 years of IT experience. Does it matter that the degree profile has to match?

Please let me know as my company is ready to transfer if there is no problem.

See the labor certificate

The form ETA 750A from DOL mentions the requirements for the labor. It says in section 14 and 15 the required education and experience.

Get hold of this form and compare these sections with your qualifications and experience.
