I had a question about the I140 process. I have an I140 from 2001 which I have now used to apply for CP. In Aug 2002, I applied for a new I140 based on a different labor cert - this labor cert was not really mine, it was someone who left the company. (I had to do this since my current salary does not meet the requirements in the original labor cert). My second I140 has been pending since Aug 2002.
I have spoken to my lawyer and he says that once my new I140 is approved, he can swap the I140's in the CP application - says that is not an issue.
Does anyone know of any such cases. Does this cause any delay in the processing of the second I140?
