My wife was checking the AVM regularly for the past few weeks. Today the latest certification was 09553749, RD 3/31/03. You should keep calling the AVM...
I hope your case gets certified soon!

Wow. That's a good number of approvals. But still, 3/31 :-(

I have a dumb question. My case # is 95592XX, RD 4/4/03, EB3. Does it mean there are still more than 6000 cases before me? I can't see any hope that they will ever touch my case within a year or two, with their processing speed like this.

Here is what I have received today from murthy.com. Does this mean that April 2003 cases will also be shipped to BECs?

"The DOL indicates in the February 16th memos that, as of February 4, 2005, approximately 25 SWAs had shipped more than 90,000 cases to the BPCs. Labor certification applications with SWA receipt dates of 2003 and 2004 are scheduled to arrive at the BPCs by March 31, 2005. A third shipment of cases was added to be sent to the BPCs by April 22, 2005. This will not only include all labor certifications properly filed at the SWAs in 2005, but also cases opened by the SWAs that are yet to be completed. The DOL anticipates that no labor certification cases should remain with the SWAs after April 22, 2005.

It is unclear at this time how many cases remain with the SWAs and whether they will be able to meet the shipping deadlines. Neither has the DOL provided any information on whether cases opened by the SWAs will be processed any differently from other unopened cases they receive. Therefore, it is possible they will simply place them in First-In / First-Out (FIFO) order along with the rest of the cases, as originally planned."

Hi Gp111, Please can you comment on this..

No SF DOL will not ship APRIL-03 RIR cases (& Jan to Sept Non RIR) to BEC as they will be working on these cases for the rest of the year. The murthy article was for SWAs..

They can take thier time to finish the rest of the cases ....

HAHA. As my bad luck would have it, my RD 4/14 has similar numbers as 3/31. And 3/31 has taken what 3 months already?

Great. Will wait patiently.

New update from Dallas/Philly thread

BEC Update from orissa -- Is this possible?

1- We are still sending 45 days continuation letters.

2- When we will see some results?
I can't give you a time frame for that, but we are working hard for it.

3- If your 45 days letter has been replied, soon decision will be mailed.

4-How soon one month, 90 days or 6 month or year?
Again I don't know exact time frame, but certainly not more than 6 month.

5- We have thirty thousand cases pending of 2001, currently we are sending decision letter. Then we will move to 2002 and 2003 so on.

dol process question

Hi Gurus,

Does dol process based on RD or case numbers? Sometimes later numbers have earlier RD and vice versa...

Any guess how many 3/31 are still to be done out of 250?

One proposal

Hi My friends,

Don't believe DOL!
We are the hostages of them to keep their job. They just make the situation worse and worse.

Please think what the Backlog Elimination Center have been done so far. How many cases they processed in the past half year: ZERO

Please consider their procedure:
Transfer case data from regional office.
It is just a game. If it is necessary and that means all the data in the regional office are invalid, or regional office had been done nothing. It may take forever because there are new case everyday.
45-day letter.
Another game. If the data post in this forum is true, only 300/40000, no more than 0.75% case had been withdrawn, how long it take? another year!
On the other hand, if they handle case timely, there is no need to verify whether you want continue or not.

In summary, they take one year to transfer data and another year to send 45-day letter, then back to the original point. In the meantime new backlog is ready!

Before Backlog Elimination Center we at least know the processing time even it is very slow in California, but now what do we know, NOTHING!

What we should do now is to stand up, let everyone know how the DOL works.
One proposal: everyone who is waiting Backlog Elimination Center sends a letter to Secretary of DOL, Ms. Chao; everyone who is waiting Backlog Elimination Center sends a letter to every Senator and Representative.

TO ASK Backlog Elimination Center PROCESS IMMEDIATELY

Please remember, only one can help you is yourself!

Thanks

I agree totally! Good analysis. We all have accepted our fate and are ready to wait till eternity whereas these BEC staff will delay things deliberately to hold on to their jobs.I think the idea of writing letters to Secretary and Senators is good but let me re-iterate the way things work in this country-Litigation!! We need to file a legal lawsuit against BEC, the way Rajiv Khanna did it for 140 & 485. I think that there was an effort to do that by someone named "sandeep0902" in this thread but Rajiv Khanna suggested that time to wait since BEC was just getting started. We can initiate this process, maybe after July/Aug,if BEC does not start processing approvals by then.We need to observe processing of BEC for few more months before we initiate any litigation.

And we may need some financial funding by the members of this thread to pay for lawyer fees. These are my views.Buddies-please comment...
