Salary requirement for Job change

I used substitute labor for GC and got laidoff from original GC sponsor. I after a big struggle, I got a copy of my LC. If I make what is mentioned in LC is it enough to satisfy NSC?

Sure! your goal is to have same or more salary (if High then over 20% will raise a Q) then mentioned in LC.
IF mentioned 70K and u r making 70K then u r just fine. No problems.
 
My thougths

Hi,
I feel higher salary is not an issue due to following reasons:

1) No one can expect to be working for same salary that LC is applied, because in any Service Center, from the day LC is filed, it takes a min of 3 years to reach to approval/RFE/interview time and no one will be on the same salary for 3 years with no improvement in salary as yearly rise is a legal thing.

2) using AC 21, Higher salary or too high salary is ok when we are moving from a low cost living area like NC to a higher cost living area like CA.

3) and finally it depends on the way our lawyer deals with Ac 21.
for example: I have heard some lawyers saying, Using AC 21, we cannot change the region from which LC is filed. But I know people in person who got approved when they changed the Service center using AC 21.



These are my thoughts. Please post ur thougths.

:) My attorney with whom I filed my LC/I-140/I-485 and my new company (used AC 21) attonery, both said ok to have higher salary as long as Job Duties remain same.
 
For AC21 wide variations(+/-) of salaries have been reported. AC21 has no geographical limits. The only requirement is 'similar' job- BCIS looks at it liberally.

Hi,
After using Ac 21, my salary is doubled the amount than specified on LC. Do u think it may create a problem. My LC is in NC but my client where I took offer using AC 21 is in CA which is a costly state. Can u please suggest.
 
Should I be worried about Prevailing wage?

Guys, Thanks for your response. The reason I am asking this question is when I check the DOL website (flcdatacenter.com/casesearchperm.asp), my case info says Prevail Wage is 15% higher than my current salary.

X (LC Salary) -> X + 12k (current salary) -> X + 25K (Prevail Wage on the website)

Should I be worried about Prevailing wage?
 
Yes, I-140 approved. Changed job twice already (Hope I don’t have to change again before my GC). Not yet filed for AC21.
 
How about less Salary?

I joined another job(AC21) with 4.8% less than my LC salary. Would that be an issue? Should I be concerned about it? Any comments and suggestions would really help me.

Hi,
My assumption is just a minimum low pay will not create a problem. I have seen few posts on this web that got approved when pay is about 10-15% less.

Thanks for your reply. It is good to hear approvals with less pay than LC. Was there any denials based on this reason(salary being less than LC - 4.8%)?
