I will go outside of US using AP.Whether I switch to use EAD before I leave US or after I am back?Any comments will appreciate!

After...

But if you are with your sponsoring employer (or with the one whom you are going to be with after GC approval) AND YOU HAVE A VALID H1 with that employer, you don\'t need to use EAD.

re:still a question,help please.

jaxen ,
Thanks!
But my situation is like this:I have H1 but no stamping in my passport so I have to use AP whcih will invalidate H1.So I have to switch to EAD for working. My question is when I will switch :before I leave or after I am back?

Answer...

you can also try to get the stamping done while you are at your home country.
However answering your question,One follows another. That is if you have EAD and you USE it then the next time you travel you SHOULD use AP. By using EAD , you have invalidated your H1.

However, if you use AP to enter (and not used EAD before) then you CAN start using EAD afer coming back. However, H1 is not invalidated by AP usage alone. If you are with your sponsoring company and you get a valid H1 stamp (St.Louis or visit to canada) you need not go to EAD.
The whole premise is based on the fact that status is recorded by your employer and needs to be sent to INS only when asked for. Talk with your employer and lawyer as to how are you going to get the H1 stamp after coming in AP (or if they also agree with you in getting teh H1 stamp). This is crucial because by switching to EAD you might be saving your employer some money when they file H1 for somebody else.

You say "use AP to enter (and not used EAD before) then you CAN start using EAD afer coming back".Are you sure it\'s afer coming back not before leaving? How to start using EAD?By filling I-9 form and telling HR?tHANKS AGAIN!

If it does not make any difference to you...

You can use EAD before going out. If you are uncomfortable about this do what is comfortable to you. Since you already have a valid EAD it does not make any difference.
Yes fill up Section 1 of I-9 and give the copy of EAD to HR. They will fill the rest and will retain I-9.
