All,

Here is my scenario, I will be completing my 6 years on H1B on 16th Feb, 2005. When my company had sent papers for visa extension last time (June, 2004), the H1B extension and I-94 I have got is till year 2007. Should I again file for 7th year extension (based on pending I-140/485) or can i keep on working on the visa extension I alreday got.

Thanks a lot for your time and help.

Thanks alren for your reply.
I already have my EAD/ Advance Parole but wanted to keep my H1B valid
incase these is a issue with I-140. Also since I am under EB3 it might take couple of years before BCIS even touches my 1-140.

The funny part is when I had sent my visa for revalidation to St.louis early this year, even they stamped the visa till 2007. So my I-94, I-797 and visa stamped on passport is valid till 2007.

How come your visa/H1/I-94 are 2 years beyond the 6 yr. expiry date. If I were you I would consult a lawyer. From what I have read on this forum even if it is a USCIS mistake you should get it correted.

If your I485 is pending more than certain date, when you apply for H1 7th year extension, the extension is for 3 years.
rincytom.

Since when has this being the case ...?

I would get it corrected by filing the 7th year extension even though its a USCIS/DOS error.
