HOW TO CHECK STATUS FOR PENDING LC APPLICATION:

a) USING E-MAIL

Send a mail to "LCSTATUS03@doleta.gov" with no subject and just put following in text....

Employer Phone (xxx) xxx-xxxx
OR
Tax ID XX-XXXXXX
OR
Case XXXXXXX

b) USING AVM

Dial (215) 861-5286, & follow the instruction(s). When system prompts you to enter case #, enter “Case Number”.

If you don’t have case number, you can also use Employer Tax-ID OR Phone number (Number listed on PART-A of LC application). If you use this option, you will hear status of all the cases applied by your employer; those are preceded by DOT code. If your company had filled multiple LC application, then you might need to do some guessing based on dates and DOT code.

News like this of 90,000 cases is really frustrating. What kind of rationale do administrators here have when they have a backlog reduction center which actually is increasing the backlog. The whole planning seems to be messy behind every move made by these people. Can the attorneys at AILA and other attorneys not protest against such messy operations planning adhered to by DOL and mmiration personnel.

Isn't there any way to make these guys listen and take some proper action.
 
I'm a lil sceptical about the 90000 figure. Why? because it does not add up.. there are only 50000 cases in DOL nationwide, and all of them have certainly not been moved to philly brc. Otherwise LC would have stopped everywhere else.
The # of pending labors in philly is around 11000-12000. The sesa does not have 80000 cases, and in any case sesa cases are not being transferrred. seems the lawyer was mistaken or simply trying to brush off questions in the hope he/she wont be called again for a while :)

Is there a way to find out ur employer's tax ID #? I do not have my W2 with me right now and cannot therefore find it

The American Immigration Lawyers Association (AILA) reported on September 17, 2004 that the labor certifications (LCs) pending at the Dallas and Philadelphia regional Department of Labor (DOL) offices are currently being transferred to the Backlog Reduction Centers in those cities. This is to be distinguished from the Labor Condition Application (LCA), which is only required for H1Bs or temporary work status. The LC is filed when an employer processes permanent residence or the green card for an employee or prospective employee.

Is Backlog Reduction a Reality?
In fact, not only is backlog reduction a reality, but DOL has changed the terminology it is using. Backlog Reduction Centers are now being called Backlog Elimination Centers. The new Directors for these Centers are Steve Stefanko in Philadelphia, PA and John Bartlett in Dallas, TX.

How Does Backlog Elimination Work?
As pending LC cases are transferred, the DOL will send letters to employers / sponsors and their attorneys to give notice that the cases have been transferred to the Backlog Reduction Centers and to request any additional information, including if the employer / sponsor wishes to continue with the LC processing for the employee/s. The employer must send a complete response to each letter within 45 days or the case/s will be closed.

Make the Response Timely and Complete
AILA is working with the DOL to get a reasonable application of this rule so that the DOL, in its desire to eliminate its backlog, does not reject hundreds or thousands of cases due to employers' failures to make timely and full responses, addressing all the issues. It is important for employers to work with knowledgeable and qualified immigration attorneys to respond effectively so that the case/s will be considered viable.

If you have all your H1 petition document, you can find the employer tax id somewhere there.

I think it's in I-128.

Maybe, the best name is Backlog Accumulation Center!

Why do you think SESA cases will not be transferred to BRC? Please post the source. Please let me know so that I can ask my lawyer about that.

Any Update any luck yet ?

I talk to my lawyer, he has no Idea what you all talking about BRC. Even though he said Aila has no update yet from so called BRC or BEC.

My receipt date at DOL Philly is 08/26/2004, Lawyer expecting another 12 to 14 month or more.

Then your lawyer is really an irresponsible idiot. The number this lawyer was talking about is also baseless, what he said is only a blind number!! I suggest you to change a lawyer, if you can find a good one.
