Passport expiry and I-129

Hello nelsona and others who can help me:

As I said in another post, my husband was planning to go to the border and get his second TN, and he just found out that his passport will expire this April. My questions are:

1. I know you need to have a valid passport when you are apply for a TN at border, is there any requirement about your passport's validity date?
2. If the company is willing to files I-129 premium processing for you, is there also the same requirement about your passport?

Not quite correct.

Border-issued I-94's for TN are subject to passport expiry date limits.
However I-129 issued I-94's are not. The full requested period will be honored.
Of course, for border, if you do get a shorted I-94, you can simply go back and ask for remainder when new passport is issued. This would not be considered another TN petition.

My husband decides to talk to the company and see if they can file I-129 or let him renew his passport first, which needs about 20 business days. Thanks again, have a good weekend!
 
Yes, in his case I-129 renewal would be best . Make sute they submit the I-539 for your TD!
