Overstaying E2 Visa

Hi,

My E-2 visa expired in July 2008 wich I couldnt renew because of illness and I had to stay in order to procure funds to leave the country. I lost everything through illness at this time. Also my son who was overstaying on a student visa.
Finally I've got our flight booked leaving in 2 weeks but heard from friends there might be a fee or other consequences leaving the States through Airplane back to my home country in Germany.
Are there any fees or consequences I have to fear?

I dont know what 'consequences' the State Dept or ICE could enforce in your home country? Its doubtful there will be any consequences unless you try to re-apply for a visa or try to re-enter the US.
 
I doubt you have to pay a fee. but you will not be able to re-enter within the next 10 yrs or longer....but I assume you don't even want to come back after what you went through.
