Out of Status after H-1

I entered USA on H-1 visa. For some reasons I decided to change employer and my new potantial employer appleied for transfer and renewal of my H-1 before expiration of old one. I refused my previous employer for renewal of my visa. For un-known reason my case is in pending at INS for around one year. I don\'t know about my status.
Do I work as per ACTA (passed in October 2000)
Do I apply for change of status under LIFE (passed in December 2000)
