NY DOLL is going to clear April 2001 cases in a few months, plrobably before June. Then they have to process about 15,000 cases to clear the entire 2001 year. It may take additional 10-11 months.

Does anybody know how much cases there are for 2002 year?

RIR processing time was already April 2001 almost 2 years ago (in April 2002).

They say they can process around 1,500 cases per month, so 39,000/1,500=26 moths or 2 years and 2 months. From what date should we count this time?
If from April 2002, the expected clearance is end of June 2004...
Then we need to wait 10 months more to clear the entire 2001, which has 15,000 cases, filled within May-December 2001.

US DOL has updated their processing times today.

Only New York and Indiana RIR are still on April 2001.

They say nothing will change with NY DOL until June or July 2004.

The promised backlog reduction centers are not opened.

PERM implementation is very questionable even this year.

No good news, colleagues.
 
Unbelievable, but NY DOL automated phone line states RIR processing time is June 2001.

We remember one year ago they started May 2001, and later the date was returned back to April 2001.

It could be a huge trick from NY DOL. They still may have unprocessed cases from April 2001.
Anyway I do not expect fast processind from them. The entire RIR 2001 may be cleared in the end of this calendar year.
 
Unbelievable, but NY DOL RIR has been moved to June 2001. It was a long, long way to everybody in this forum, who was waiting for "good news".

I remember hot discussions about NY DOL backlog during years. And April 2001 milestone has officially been cleared today.

The legitimate question is: how fast will they process the rest of 2001? I would expect one month in one month. Seven months more to clear 2001.

I had a conversation with my lawyer today.
Hi is not positive about one RIR month in one calendar month processing by NY DOL.
He told “nobody knows when even they complete the current backlog”.
Also he confirmed that PERM may be a big challenge for computer specialists. Fortunately it will not be implemented this fiscal year.

President Bush signed into law an $820 billion Omnibus Spending Package that includes funding for the Labor Certification Application (LCA) program. Because the funding for the PERM LCA program has been finalized, the Department of Labor (DOL) can forward the PERM regulations to the OMB (Office of Management and Budget). The OMB oversees and coordinates the federal government's procurement, financial management, information, and regulatory policies. Once the OMB has the PERM regulations, it can take 90 days for review. Thereafter, the final PERM regulations will be published in the Federal Register, a compilation of regulations open for comment and review by the public. Once published, detailed substantive and procedural rules for PERM will become available. Even after publication, however, it appears that an additional 120 days will be required for the PERM to be implemented.

If Bush signed it, it means the PERM is not favorable for proffesional immigrants. More tough to come.
 
PERM. DANGER!

They say there will be an option to convert RIR to PERM starting a new advertisement company under PERM requirements. If you try to convert, you will have a risk to be denied by DOL due to:

Scenario 1. Many candidates reply to the advertisement. At least one may be considered by DOL as a person suitable for the work. Your case will be denied.

Scenario 2. Nobody responds to the advertisement. You case will be denied due to unduly job requirements.

Scenario 3. You will decide to stay with RIR after PERM implementation. Let say if only 50% PERM cases will be approved before your RIR is cleared, another huge I-140 backlog will delay you GC for years.

I do not see any advantages from PERM.
 
NY RIR is still on June 2001. The regular has moved from March 2001 to April 2001.
I have a guess they processed only regular cases during last month.

Guys, do not expect much from NY DOL. Try to find alternatives for your GC.

You are right. Today I have a long discussion with my lawyer and he recommended another faster way for GC, because NY DOL may stay on 2001 cases very long time.

I will try.

I am more or less in the same situation, Labor pending for nearly 2 years at NY DOL, could you please let me know what your lawer recommended? I would greatly apprecaiate your help.
 
According to DOL web site NY state has moved to July 2001. We can estimate their progress - it roughly one RIR month in one processing month or a little slower.
We can expect they clear RIR 2001 to the end of this year.
